Controversy Surrounds Proposed Conversion Therapy Ban in Scotland

As Scotland heads towards its upcoming parliamentary elections on May 7, a new legislative proposal has stirred significant debate. The Scottish National Party (SNP), along with Labour and the Greens, have all committed to implementing a ban on conversion therapy, a move they claim will protect LGBT individuals.
According to opinion polls, although the SNP has seen a decline in support over the past five years, it still maintains a lead of approximately 10 points over Labour and the Conservatives. This political landscape forms the backdrop for the contentious issue at hand.
The SNP’s manifesto specifically calls for a prohibition on “harmful conversion practices.” Supporters of this ban argue it is a necessary step to shield LGBT individuals from abusive practices. However, critics argue that existing laws already address abuse in therapeutic and counseling contexts.
Opponents worry that such a ban could inadvertently criminalize benign activities. They cite examples such as religious leaders offering counsel to those experiencing unwanted same-sex attraction or parents advising their children on gender transition.
Aidan O’Neill, a KC who represented For Women Scotland in a significant Supreme Court case, criticized the proposals as “fundamentally illiberal in intent and effect.” He expressed concerns that these laws might inadvertently penalize routine pastoral work in religious communities.
The Christian Institute is actively opposing these legislative plans and has initiated the “Let Us Pray” campaign. The campaign aims to highlight potential overreach in the proposed ban.
Joanna Timm, a spokeswoman for the campaign, stated, “Gay and trans people are already protected from abusive and coercive practices under Scots law.”
She further argued, “Campaigners are clear that they want a ban to compel parents and clinicians to medically transition gender-confused young people, and to criminalise Christians for expressing traditional views on sexuality and gender.”
Timm also expressed astonishment that major political parties would support a bill that might lead to ordinary citizens facing legal repercussions for dissenting from LGBTQ+ advocacy demands.
