NC Bill Seeks to Restrict AG’s Power to Challenge Trump’s Orders

A proposed legislative measure in North Carolina aims to restrict the authority of the state’s attorney general, Democrat Jeff Jackson, from pursuing legal action against President Donald Trump.

The legislation, having cleared the state Senate, is pending a vote in the House. It seeks to prevent any attorney general in North Carolina from initiating lawsuits that could lead to the “invalidation of an executive order issued by the President of the United States.”

Republican Sen. Tim Moffitt, who co-sponsored the bill, remarked on its nonpartisan intent, stating, “It’s simply to keep our attorney general focused on the things that they should be focused on, which is really protecting North Carolinians.” (source).

If passed, this would uniquely position Jackson as the sole attorney general nationwide restricted from challenging the president in court. Attorneys general across the U.S. frequently engage in legal actions against presidential decisions that clash with state interests or legislation.

Earlier this year, Jackson and 22 other attorneys general filed a lawsuit against the Trump administration’s initiative to halt trillions in federal grants. A federal judge recently issued a preliminary injunction favoring their case.

In response to this legal victory, Jackson expressed on social media the necessity of maintaining the power to contest unlawful executive orders, emphasizing its importance in safeguarding the state’s economic and future interests.

Historically, this is not the first attempt by North Carolina Republicans to limit the influence of a Democratic officeholder. A previous effort in December aimed to transfer control of the state Board of Elections from the governor to the Republican state auditor, currently facing legal challenges.

With Republicans lacking a veto-proof majority in the General Assembly, Governor Josh Stein has the ability to prevent the enactment of the bill that seeks to curtail Jackson’s legal powers.

Historically, state attorneys general have been active in legal challenges, with 122 lawsuits filed against the Biden administration, predominantly by Republican attorneys general, accounting for approximately 93% of these cases.
