Concerns are mounting over proposed legislation aimed at ending “abusive conversion practices” targeting LGBT individuals, with critics arguing it could infringe upon free speech and religious freedoms.
While the intent behind the law is to cease harmful attempts to change an individual’s sexual orientation, the Free Speech Union (FSU) warns of potential overreach, aligning with perspectives from groups like Christian Concern.
According to the FSU, existing laws already make it illegal to coerce someone into changing their sexual orientation. They question the necessity of additional legislation, asking, “Forcing gay people to attempt to become straight is already illegal — so the obvious question is: what, precisely, is Labour proposing to prohibit that is not already prohibited?”
Echoing this sentiment, Paul Huxley from Christian Concern highlighted that notorious practices such as electroshock therapy and chemical castration are already banned, and there is no record of “corrective” rape being recommended by therapists in Britain.
Critics are particularly concerned about the potential criminalization of activities like prayer or counseling for individuals questioning their sexual identity. This could extend to conversations between parents and children regarding gender identity.
The FSU cautions that the new law might hinder “good-faith, exploratory conversations” between medical professionals, parents, and children experiencing gender confusion. They argue, “The word ‘abusive’ is doing an enormous amount of work in the bill’s title.”
They further stress that the distinction between a supportive clinical discussion and an abusive act lies heavily on the legislative language and its enforcement, committing to a thorough examination of both.
Legal experts have pointed out that any anti-conversion therapy legislation could clash with human rights laws. This issue previously led the Conservative government to retract their support for similar measures, due to conflicts with free speech principles.
